About Us
SpreadFighter is the data controller responsible for your personal data and is the sole owner of the SpreadFighter.com website ("Website"), SpreadFighter mobile and desktop applications, SpreadFighter services (each, a "Service") and all of the information collected on it. SpreadFighter collects information from users in several ways (explained in detail in this privacy policy).

This privacy policy applies to personal data that we collect from you when you visit this Website, create an account, use our applications or services ("you" or "your" being interpreted accordingly). It provides information on what personal data we collect, why we collect personal data, how it is used, the lawful basis on which your personal data is processed, how it is stored, and how we share information.

Personal data that we collect
There is no need to create an account when searching and viewing information from certain markets, such as symbols, quotes, financial data, as well as ideas and publicly available data of SpreadFighter users.

Data we receive from you
User Accounts
If you decide to create an account, you will need to provide us with some personal data so we can provide you with access to our additional services that users benefit from. You may also elect to provide us with additional information about you, as described below.

During registration you will be required to provide us with either:

your username, email address;
your account information with one of the following social Internet services: Facebook, Twitter, Google, Yahoo!, LinkedIn, Apple; and
if you want to buy a subscription, we will need your first name, last name and postal address.
In some cases, you may need to provide and verify your phone number. You can also add additional information about yourself in the profile settings, however, this is not mandatory.

The following information will be publicly displayed:

username, the image you have elected to provide as your user avatar, signature, “About me”, Twitter handle, YouTube channel link, YouTube username, Facebook profile, Instagram profile and website, date joined, subscription level.
The following information will not be publicly displayed:

your first and last name, phone number and email.
If you register to be a user of Essential/Plus/Premium/Expert/Elite/Ultimate Accounts (a "Paid User"), our third party payment processor will also process information about your payment card and bank account information or payment account information that we require for the purpose of recording and processing your account registration. For further details, please refer to the point below titled "Payment information", under the section headed, "When we share your personal information."

Contact data
We also process any personal data you choose to give when corresponding with us by phone, email, or otherwise visiting and interacting with this Website or any other services we operate.

Partners data
We also process personal data you choose to give at registration and connection to the Partner Program (for more information please see Partner Program Rules).

Cookies and other technologies
We use browser cookies (small text files placed on your device) to administer our Site, gather and analyze statistical information, ensure security, to fight spam, and for advertising purposes. Cookies allow us to provide you with a better user experience when you browse our Website and also helps to improve its features. Log files
Like most websites, we use web server log files. Records in our log files include internet protocol (IP) addresses (see the "Device information" section below for further details), browser types, internet service providers, referring pages, exit pages, platform types, and date/time stamps. We use web server log files to administer the site, provide broad traffic information for site planning purposes, and to ensure that our terms of service agreement is being adhered to. Note that IP addresses are not tied to personal data in our web server log files.

Device information
We collect the following information about the devices you use to interact with our services: IP address of the device (from which we can also infer the country you are connecting from), device type, operating system, application and browser version. We collect this information to prevent spam and abuse of our services. IP addresses may be considered personal data in certain jurisdictions, and will be treated in accordance with this privacy policy.

Analytics
When you are using our Website, mobile and desktop applications, or widgets we provide to another site, we may collect analytics information automatically. This information may include your general device information, device identifiers (for example, Google Advertising ID, if you are using an Android device, or Advertising Identifier (IDFA), if you are using an iOS device), network information, website, and application interaction events. We collect pseudonymous data only and this analytic information does not include any personal identifiable information from your profile. We use this information to analyze and improve the work of our services and applications, and to develop, test, and improve our service further. For this purpose we may use internal analytic as well as third party service providers. Data we receive from third parties
When you sign in to your account using your internet service credentials (Facebook, Twitter, Google, Yahoo!, LinkedIn, Apple), such service sends us your username and the email address associated with the credentials you've used. We neither control nor take any responsibility for the way third parties provide information about you and/or process your personal data.

How personal information is used
We use personal data in various ways that are necessary to provide the services you intend to use, certain legitimate interests, and as a necessity in order to comply with applicable law, as further described below.

We do not generally rely on your consent to allow us to process your personal data if there is another lawful ground available. If we do rely on your consent, we will make this clear to you at that time.

Profile
A profile is a set of information for each individual user that details his/her viewing preferences. User settings (chart settings, toolbars, buttons, etc.) are kept solely for the purpose of customizing the user’s experience when using the Website, applications or user accounts. We do not share private profile settings with any third parties.

Note that when you create an account, other users or visitors may access your public profile and see any information you have made publicly available about yourself.

User account and profile operations
We use your contact details, such as username, email address, or phone number, in the following ways:

to authenticate your user account, ensure its security along with the security of our services, and to prevent spam, fraud, and abuse;
to acknowledge, confirm, and deal with your user account;
to send all new users a welcome activation email to verify their email address;
(For Paid Users) to provide you with subscription services and contact you regarding your use of such services. This is necessary for us to implement your requests; and
Paid Users will also receive a notification email from our payment processor if there are any issues regarding billing their cards for auto-renew subscriptions. Users cannot opt out of these messages, though they can delete their account.
User account deleting
You may refuse to use our Website and/or application and may ask us to delete your account in the Profile settings. Your account will be deleted after 30 days. During this time, you can stop the deletion process at any time.

Please note that if you have requested your account to be deleted, we will delete the subsequent personal data you have supplied us. However some data, such as published ideas/scripts and messages sent to other users, will be saved as they have already integrated into our system. This data must be stored to maintain the integrity of the platform, as well as for legitimate business processes, including audits and security purposes.

Note that search engines, as well as third parties, can keep copies of your publicly available information once your account has been deleted. It should also be noted that published ideas will remain on the site and messages sent to other users cannot be deleted.

Marketing
We may send you marketing emails about our products or services that are similar to the products or services you are subscribed to, including information about events and other promotions we feel may interest you. This is unless you have indicated to us that you do not wish to receive communications in this manner. We will send you other promotional information by email only with your consent, which was given at the time you provided us with your personal data. Users can opt out of receiving marketing communications at any time by clicking "unsubscribe" in one of the emails (for more information on your rights, please see the "User rights" section below).

Social Notifications
We can notify you via email about new users who have followed you, liked an idea, new ideas of users that you follow, and so on. You can refuse to receive such notifications at any time by adjusting your Profile settings.

Service-Related Announcements
On rare occasions, it may be necessary to send out service-related announcements. For instance, if our service is interrupted for a prolonged period or a major functionality upgrade is released, we might send all users an email message.

Customer Service
When you open a support ticket, we use your contact details as well as information about your device, server logs, a description of the problem, along with any other supporting materials (videos, screenshots, etc.) to help resolve the issue(s).

API
If you are using our API (Application Programming Interface) services (such as the Advanced Charts, Trading Platform, REST API), then we may process your personal data in order to be able to provide and support those services.

Legitimate interests
We will process your personal data as necessary for certain legitimate business interests, which include the following:

where we are asked to respond to any of your inquiries, comments, or grievances;
to administer our services in order to better understand how visitors interact with the Website and application, and ensure that they are presented in the most effective manner for you and your computer/device;
to develop and improve our mobile applications;
to share personal data among our affiliated businesses for administrative purposes, provide subscription services, and in relation to our sales and marketing activities, except where we require your consent, as described above;
to send you information about our products or services that are similar to the products or services you subscribed to (unless you have refused or opted out of receiving these emails at the time you provided us with your email address or you have indicated to us that you do not wish to receive communications in this manner). Our legitimate interest is to ensure our marketing is relevant to you, so we may process your data to send you information on our products or services that is specifically tailored to your interests;
we may anonymize, pseudonymize, aggregate and de-identify the data that we collect and use this data for our own internal business purposes, including sharing it with our business partners, our affiliated businesses, agents and other third parties for commercial, statistical and market research purposes. As used in this privacy policy, “legitimate interests” means the interests of SpreadFighter and our affiliated businesses in conducting and managing our business. When we process your personal data for our legitimate interests, we make sure to consider and balance any potential impact on you and your rights under data protection laws. Our legitimate interests do not automatically override your interests. We do not use personal data for activities where our interests override the impact they may have on our users, unless we have their explicit consent or those activities are otherwise required or permitted by law. You have the right to object to the processing of your personal data that is based on our legitimate interests at any time, on grounds relating to your particular situation (for more information on your rights, please see the "User rights" section below).

When would we share personal information
We share your personal data with third parties in the following situations:

Service providers: SpreadFighter, like many businesses, occasionally engages with selected third parties who act on our behalf to support our operations, such as (i) card processing or payment services (see the point below headed "Payment information"), (ii) IT suppliers and contractors (i.e. data hosting providers or delivery partners) as necessary to provide IT support and enable us to provide subscription services and other goods/services available on this Website or to users, (iii) web and mobile analytics providers, (iv) providers of digital advertising services, and (v) providers of marketing and sales software solutions. Pursuant to our instructions, these parties may access, process or store your personal data in the course of performing their duties to us and solely in order to perform the services we have hired them to provide.
Payment information: Paid Users must provide payment information (name, postal address, payment card information or payment account information). This information is used for billing purposes only and is processed by our payment processors. When you are making a payment, we do not have access to your payment card information. Should we have any issues with processing an order, the email address you have provided will be used to contact you. Third Party Content Providers: When you buy market data from ICE or other stock exchanges, we give them your contact details (name, phone number, address and email) and you sign the agreement. This data is also processed by ICE or other stock exchanges in order to provide you with access to the exchanges.
SpreadFighter affiliated businesses: In order to provide the services you request from us, our affiliated businesses may access and process the information which we collect from you for the purposes described above, including offering products and services to you. Our affiliated businesses will only use your data for the purposes for which we originally collected said data.
Analytics providers: We may use third-party service providers to monitor and analyze the use of our services and mobile/desktop applications. We use this information to analyze and improve the work of our services and mobile applications.
We may use Google Analytics as a web analytics service on the Website, mobile apps and in conjunction with the widgets we provide. For more information on Google Analytics privacy practices, you can check here.
Analytics services for mobile and desktop applications that we may use:
Firebase — a development and analytics platform provided by Google. For more information on what type of information is collected, please visit the Firebase web page.
Flurry Analytics — provides us with tools and resources for understanding our mobile application users’ behavior. For more information on the handling of user data on Flurry Analytics, please see their Privacy Policy.
Visual Studio App Center — owned by Microsoft. Their applicable data protection provisions can be reviewed under the Microsoft Privacy Statement.
AppsFlyer — analytics services to measure and analyze the effectiveness of our marketing and advertising campaigns, as well as certain events and actions in the application. For more information on how AppsFlyer works and what data it collects, please see AppsFlyer Services Privacy Policy.
Sentry — is an error tracking and performance monitoring platform that helps us diagnose, fix, and optimize the performance of our platform. For more information on what data collected by Sentry, please see Sentry Privacy Policy.
Business transfers: If we sell our business or our company assets are acquired by a third party, personal data held by us about our general account users, subscription account users or customers may be one of the transferred assets.
Administrative and legal reasons: If we need to disclose your personal data (i) to comply with a legal obligation and/or judicial or regulatory proceedings, a court order or other legal process, (ii) to enforce our Terms of Use, House Rules or other applicable contract terms that you are subject to, or (iii) to protect us or our contractors against loss or damage. This may include, but is not limited to, exchanging information with the police, courts or law enforcement organisations.
Advertising: We display advertising on the Website and may use remarketing and tracking features. Remarketing features allow us to display advertising in a more targeted manner in order to present advertisements of interest to users, based on their activity on other websites. Tracking features allow us to collect information about impressions, ad clicks and certain actions that users complete through our Website. This data also helps us evaluate the performance of ad campaigns. Note that we collect pseudonymous data only. We may use the following services for advertising, remarketing, and tracking purposes:

Meta pixel — allows us to measure, optimise, and build audiences for our advertising campaigns.

Twitter Conversion Tracking (Twitter Pixel) — helps us to measure our return on ad expenditure.
For more information about Twitter data processing, please see their Privacy policy. You can adjust the settings in your personal Twitter profile and opt to receive advertising. In case you don’t have a Twitter account, you can use Your Online Choices website or DAA's WebChoices Tool to manage your ad experience.

Note that we do not share any personal information with our advertisers. They can only access general statistics that include the amount of impressions their ads have generated as well as clicks.

Google reCAPTCHA: We use reCAPTCHA to check whether data has been entered by a person or by an automated program. We use this service to protect our services from spam, fraud and abuse. reCAPTCHA analyses the behavior of the visitor using various characteristics and evaluates various information for analysis purposes (e.g. IP address, visit duration, or the user’s mouse clicks). This analysis begins automatically, as soon as the website visitor accesses the website, and runs in the background. Visitors are not informed that an analysis is being performed. The data recorded during analysis is forwarded to Google. YouTube API Services: We use YouTube API to share your chosen video ideas and video streams to your YouTube account. When you use this service, you will need to sign in with your Google account and grant us permission to access your YouTube account. We will only use this access to upload videos that you choose to share with us. We will not store, modify, delete, or view any other data from your YouTube account. We will also not share your Google account information with any third parties. You can revoke our access to your YouTube account at any time by visiting Google security settings page. By using this service you are agreeing to be bound by the YouTube Terms of Service.
Public information on our site
Public Profile
When you create your profile on our Service, other users or visitors may access your public profile and see any information you have made available about yourself. When browsing for trading ideas, they will only be able to view your market information (i.e. published ideas and scripts, markets allocation, top mentioned Symbols, etc.), social information (i.e. followers and following lists along with the ideas that you follow and comment on), contact information (i.e. your About section, avatar, links to your social media accounts, website, etc.), your community status (i.e. Moderator or Pro badges, statistical information such as reputation points, views, likes, followers, registration date, as well your last visit date). Your email address, however, will not be visible (unless you choose to make it visible).

Public content
Our Service allows those with a registered user account to share their charts with indicators and comments that can be added, their ideas, scripts, streams and other content, with the rest of the internet via our publish features.

By using a publish features, you grant us an irrevocable, perpetual, and royalty-free license to publish and disclose the content, as well as the username of the author, which makes you identifiable.

You can also publish your content as "private". This means that the content will not be displayed in your profile or your lists of ideas, scripts, streams, etc., nor will it be indexed by search engines. However, users who have a direct link to your content will be able to view it. Note that you will control over who/which users have access to a link.

When you comment on any content, we also publish certain information about your comment: including date, time and application (such as "SpreadFighter for iOS" if you commented on it from one of our applications).

Chats and Private Messages
When you communicate with other users in public and private chats, we store and process your messages and any related information. We check links to make sure there is no malicious software or content as well as to detect spam and prohibited images/text. When you use private messages to communicate, please keep in mind that the recipients have a copy of your correspondence as well. This will continue to be the case even if you delete such correspondence from your account. Recipients can copy, store and/or reshare these messages. Be constantly vigilant of this.

Security of personal data
We use technical and organizational safeguards to protect your personal data and require third parties with whom we work to do the same.

We use Transport Layer Security (TLS) encryption technology in order to protect certain information that you submit to us. This technology protects you from having your information intercepted by anyone while it is being transmitted to SpreadFighter or payment processor. While on a secure page, such as our order form, the "lock" icon in the browser window is displayed, confirming that a secure and encrypted connection has been established with the Website. We work hard to ensure that our Service is secure and that we meet industry standards. We also use other safeguards, such as firewalls, authentication systems (i.e. passwords, and personal identification numbers), and access control mechanisms to control unauthorized access to systems and data. If you have chosen to create an account, you are responsible for doing everything you reasonably can to keep your access details secret. You must not share these details with anyone else.

We also do our best to protect user information offline. All of our users' personal information is restricted to our offices. Only employees who need to see the information to perform their jobs are allowed to access it.

The servers that store personal data are located in a secure environment in a locked facility.

We are constantly improving the ways we secure, store, and process the data we collect, including the addition of physical security measures that help us counter unauthorized access to our systems. However, no method of electronic transmission or storage is 100% secure. Therefore, we cannot guarantee its absolute security.

Children and sensitive personal data
This Website is not directed towards children who are under the age of 18. We do not knowingly contact or collect personal information from children below the age of 18 years, or sensitive personal data ("racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or a natural person’s sex life or sexual orientation," etc.). At our discretion we may add links (web links) to other websites from our Website. These websites can be run by third parties with separate and independent privacy policies. We, therefore, have no responsibility nor are we liable for any content, activities or privacy policies of these linked sites. We suggest you read the privacy policy of each and every site that you visit.

Our hosted charting solutions
Some business partners use our charting solutions on their own websites. Such sites may display messages such as "Powered by SpreadFighter" or similar. We do not control the privacy policies of these sites, regardless of whether or not these messages are displayed. Again, we suggest you read the privacy policy of each and every site that you visit.

EEA and UK users' specific rights
Individuals subject to European and United Kingdom ("UK") data protection laws may have data subject rights in relation to the personal data we hold on them (described in detail below). This may, in and of itself, be subject to limitations and/or restrictions.

Accessing data
If prompted, we will confirm whether or not we are processing your personal data and if so, we will provide you with a copy of that personal data along with any other pertinent details. If you require additional copies, we may need to charge a reasonable fee, but this can be discussed and depends on the situation.

Restricting the processing of personal data
You may ask us to restrict or ‘block’ the processing of your personal data in certain circumstances, for example, if you contest the accuracy of the data or object to us processing it. We will notify you before we lift any restriction on processing. If we share your personal data with others, we will notify them of the restriction wherever possible. If prompted, and if it is possible and lawful to do so, we will also notify you with whom we have shared or will share your personal data so you can contact them directly.

Objections
You may:

ask us to stop processing your personal data at any time, and we will do so. If we are relying on a legitimate interest to process your personal data, then it should not be a problem unless we demonstrate compelling legitimate grounds for processing;
object to our processing of your data for the purposes of direct marketing at any time. This can be done by clicking the "unsubscribe" button in our marketing emails; and
refuse to receive service notifications via email (for example, when a user you are subscribed to publishes a chart, idea, etc.). This can be adjusted in the User Settings.
Withdrawal of consent
If we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. This will not affect the lawfulness with which we process your data before receiving notice of your wish to withdraw your consent. We emphasize that we do not generally rely on your consent to allow us to process your personal data if there is another lawful ground available. If we do rely on your consent, we will make this clear to you at that time.

Viewing and correcting data
You have the right to have inaccurate personal data rectified or completed if it is incomplete. In order to do so, each user can view, manage and/or update his/her personal data in the Profile Settings.

If we share your personal data with others, we will notify them of any corrections made whenever possible. If prompted, and where possible and lawful to do so, we will also notify you with whom we have shared your personal data so you can contact them directly if need be.

Deleting data
You have the right to refuse to use our Services and may ask us to delete or remove your personal data in certain circumstances. If we share your data with others, we will notify them of the edits wherever possible. If prompted, and wherever possible and lawful to do so, we will also notify you with whom we have shared your personal data so you can contact them directly if need be.

Data retention
We will keep your personal data (1) until you decide to delete your account (upon request), or (2) as required by law or as necessary for legitimate business purposes (i.e. for tax, legal, accounting, fraud, or abuse prevention, and/or other purposes). This data can be stored even after an account is deleted.

Upon expiration of the applicable retention period, we will securely destroy your personal data in accordance with applicable laws and regulations. In some circumstances we may anonymize your personal data so that it can no longer be associated with you. In this case, such data is no longer considered personal.

If you consent to receive marketing communications, we will keep your data until you unsubscribe, which is possible via the ‘unsubscribe’ button at the end of our marketing emails. Additional methods to unsubscribe may be added in the future.

Data portability
You have the right to obtain your personal data from us, which that you consented to give us or that was provided to us as necessary in connection with our contract with you. We will give you your personal data in a structured, commonly used, and machine-readable format. You may reuse it elsewhere if you so wish.

Lodge a complaint with the data protection authority

International data transfers
SpreadFighter LLC is based in the Cyprus. The information collected through Services will be stored on servers located in the United States, European Union, and other destinations (including outside the EEA), to our service providers and affiliated businesses for the purposes described above. This is necessary to enable you to navigate and use our Services. The data may be transmitted to our service providers and affiliates supporting our business operations (described above).

Note that the countries concerned may not provide the same legal standards for protection of your personal data that you have in the EEA. If we transfer your personal data to countries outside of your country, we will take the necessary steps to ensure your information receives an adequate level of security protection where it is processed and that your rights continue to be protected.

All rights, title and interest in and to any data or/and other information provided by Interactive Data (IDCO), and all such data/information made available by Interactive Data (IDCO) through SpreadFighter or our services, in all languages, formats and media throughout the world, including all copyrights and trademarks therein, are the property of Interactive Data (IDCO), our affiliates or our Data Providers (as applicable).

SpreadFighter is dedicated to providing users with a secure and accessible platform for the display of market data, charts, news, and other financial information. As such, users are strictly prohibited from employing any automated data collection methods, including but not limited to scripts, APIs, screen scraping, data mining, robots, or other data gathering and extraction tools, regardless of their intended purposes. The use of any technology to circumvent protective mechanisms designed to prevent unauthorized reproduction or distribution of SpreadFighter content is expressly forbidden.

The content on the SpreadFighter platform, including market data and other information, is made available for display purposes only within the website's or mobile app's user interface. Our licensing arrangements with Data Providers do not permit the downloading, sublicensing, assigning, transferring, selling, loaning, or distribution of SpreadFighter content for payment without obtaining prior written consent from SpreadFighter. Users are required to respect these terms, as they are designed to protect the interests of SpreadFighter, its data providers, and its user community, ensuring a secure and reliable platform for all.

Breaching these requirements may result in serious consequences, including the blocking of the user or visitor, termination of their account, and potential penalties. SpreadFighter also reserves the right to take appropriate legal actions against users found to be in violation of these terms, in order to protect the platform's integrity and the interests of its data providers and user community.

Except as otherwise expressly permitted by the preceding paragraphs, you agree not to sell any of the services or materials in any manner or for any purposes, without the prior expressed written consent of SpreadFighter and/or our Data Providers. In addition, you shall not, without the prior expressed written consent of SpreadFighter and the relevant Data Providers, make copies of any of the software or documentation that may be provided, electronically or otherwise, including, but not limited to, translating, decompiling, disassembling or creating derivative works.

Except as otherwise expressly permitted by additional agreement, we do not permit commercial usage of any of our services or APIs. 4. Attribution
SpreadFighter grants all users of spreadfighter.com, and all other available versions of the site, to use snapshots of SpreadFighter charts in analysis, press releases, books, articles, blog posts and other publications. In addition, SpreadFighter grants the use of all previously mentioned materials in education sessions, the display of SpreadFighter charts during video broadcasts, which includes overviews, news, analytics and otherwise use or promote SpreadFighter charts or any products from the SpreadFighter website on the condition that SpreadFighter attribution is clearly visible at all times when such charts and products are used.

Attribution must include a reference to SpreadFighter, including, but not limited to, those described herein.

Use of SpreadFighter charts during video or other promotions where SpreadFighter attribution is not visible, must include a description of the product used therein. For instance: "Charting platform used for this analysis is provided by SpreadFighter," or simply "Charts by SpreadFighter." Font size should not be less than 10 PT = 13PX = 3.4MM.

You can use the "Snapshot" button in the top toolbar of the chart to instantly create a picture file of your current chart. SpreadFighter will automatically take a snapshot with all required attributions and provide a link where you can view your chart, download it or share it. The use of any SpreadFighter products outside the SpreadFighter website, without a proper attribution of SpreadFighter, is not allowed. This extends to any tools (such as widgets) obtained on the SpreadFighter website and utilized on the outside resources, where attribution should remain as was originally designed and intended. Users who disobey this attribution rule herein may be banned permanently, and other legal actions may be taken to ensure compliance. This includes, but is not limited to, cease-and-desist warnings, court orders, injunctions, fines, damages relief, and so on.

5. Third party sites and advertisers
SpreadFighter may include links to third party websites. Some of these sites may contain materials that are objectionable, unlawful, or inaccurate. You agree that SpreadFighter shall not be held liable for any trading activities or other activities that occur on any website you access through links on SpreadFighter. We provide these links as a convenience, and do not endorse the content or services offered by these other sites. Any dealings that you have with advertisers found on SpreadFighter are between you and the advertiser and you acknowledge and agree that we are not liable for any loss or claim you may have against an advertiser.

Unauthorized soliciting on SpreadFighter is strictly prohibited and may result in penalties, including, but not limited to, temporary or permanent bans of the account found in violation, and any appropriate and available legal action for monetary and other damages.

6. Disclaimer regarding content
SpreadFighter cannot and does not represent or guarantee that any of the information available through our services or on SpreadFighter is accurate, reliable, current, complete or appropriate for your needs. Various information available through our services or on SpreadFighter may be specially obtained by SpreadFighter from professional businesses or organizations, such as exchanges, news providers, market data providers and other content providers (e.g. Cboe One and possibly other established financial exchanges such as the New York Stock Exchange, NASDAQ, New York Mercantile Exchange and Dow Jones), who are believed to be sources of reliable information (collectively, the "Data Providers"). Nevertheless, due to various factors — including the inherent possibility of human and mechanical error — the accuracy, completeness, timeliness, results obtained from use, and correct sequencing of information available through our services and website are not and cannot be guaranteed by SpreadFighter. We make no warranty and assume no obligation or liability for scripts, indicators, ideas and other content of third parties. Your use of any third-party scripts, indicators, ideas and other content is at your sole risk.

7. Disclaimer regarding investment decisions and trading
Decisions to buy, sell, hold or trade in securities, commodities and other investments involve risk and are best made based on the advice of qualified financial professionals. Any trading in securities or other investments involves a risk of substantial losses. The practice of "Day Trading" involves particularly high risks and can cause you to lose substantial sums of money. Before undertaking any trading program, you should consult a qualified financial professional. Please consider carefully whether such trading is suitable for you in light of your financial condition and ability to bear financial risks. Under no circumstances shall we be liable for any loss or damage you or anyone else incurs as a result of any trading or investment activity that you or anyone else engages in based on any information or material you receive through SpreadFighter or our services.

8. Disclaimer regarding hypothetical performance results
Hypothetical performance results have many inherent limitations, some of which are mentioned below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. In fact, there are frequently sharp differences between hypothetical performance results and actual results subsequently achieved by any particular trading program.

One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk and no hypothetical trading record can completely account for the impact of financial risk in actual trading. For example the ability to withstand losses or to adhere to a particular trading program in spite of the trading losses are material points, which can also adversely affect trading results. There are numerous other factors related to the market in general or to the implementation of any specific trading program which cannot be fully accounted for in the preparation of hypothetical performance results and all of which can adversely affect actual trading results.

9. Registered users
Certain services, such as saving charts, publishing them or the ability to comment on published charts, are available only to registered users of the SpreadFighter website and require you to sign in with a username and password to use them. If you register as a user (a "Subscriber") of any of the features of SpreadFighter, during the registration process you may be prompted to click "Register Now", "Submit" or a similar button; your clicking on such button will further confirm your agreement to be legally bound by these Terms of Use.

In consideration of your use of the SpreadFighter website, you represent that you are of legal age to form a binding contract and are not a person barred from receiving SpreadFighter services under the laws of the United States or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the SpreadFighter's registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or SpreadFighter has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, SpreadFighter has the right to suspend or terminate your account and refuse any and all current or future use of the SpreadFighter services (or any portion thereof).

You represent and warrant that you have all intellectual property rights, including all necessary patent, trademark, trade secret, copyright or other proprietary rights, in and to your content. If you use third-party materials, you represent and warrant that you have the right to distribute third-party material in the content. You agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including patent, privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to submit the material.

We may remove your content without notice if we reasonably believe that you're in violation of our Terms of Use.

10. Non-Professional subscriber status
As a vendor of official real-time market data from exchanges (e.g. Nasdaq) for end users, we are required to identify the status of any Subscriber. If you are ordering a subscription for market data on SpreadFighter as the 'Non-Professional', you confirm the following:

You use market data solely for personal use, not for your business or any other entity.
You are not registered or qualified with the Securities Exchange Commission (SEC) or the Commodities Futures Trading Commission (CFTC).
You are not registered or qualified with any securities agency, any securities exchange, association or regulatory body in any country.
You do not perform any functions that are similar to those that require an individual to register or qualify with the SEC, the CFTC, any other securities agency, any securities exchange, or association or regulatory body, or any commodities or futures contract market, or association or regulatory body.
You are not engaged as an investment advisor (as that term is defined in Section 202 (a) (11) of the Investment Advisor's Act of 1940) or asset manager and you are not engaged to provide investment advice to any individual or entity.
You are not subscribing to the service in your capacity as a principal, officer, partner, employee, or agent of any business or on behalf of any other individual.
You use your own capital, not provided by any other individual or entity in the conduct of your trading.
You do not conduct trading for the benefit of a corporation, partnership, or other entity.
You have not entered into any agreement to share the profit of your trading activities or receive compensation for your trading activities.
You are not receiving office space, and equipment or other benefits in exchange for your trading or work as a financial consultant to any person, firm or business entity.

Should we, or our exchange partners, determine — based on the information provided and / or companies websites, email address and domain, LinkedIn, regulatory or company registries, payment method — that you actually meet the criteria for a 'Professional' status at any point during or after subscribing to SpreadFighter or to market data from exchanges, you will be liable for the difference between the 'Non-Professional' and 'Professional' subscription rates for both SpreadFighter subscription and relevant market data. This applies retroactively from the date you initiated your subscription. Furthermore, we reserve the right to automatically invoice you for this difference and charge the associated amount to your on-file payment method.

11. Derived Data
Our proprietary derivation consumes raw market data and executes a 2-factor derivation process to produce the displayed price, later consumed by the price engine. Derived market data is sourced and supplied from various sources and can therefore be blended.

The derivation process involves changing the raw price by a factor determined by the volume of trading on the underlying market, a randomized variable and a maximum offset amount. The derived data price is only ever displayed to our non-professional clients, the derived data price then being the proprietary value of an organization.

At no point is raw data accessible by any client, nor can said data be reverse-engineered in any manner. All markets are passed through the same derivation engine.

12. Access and security
You accept responsibility for the confidentiality and use of any username and email address that use to register for your access to and use of our services. You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify SpreadFighter of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. SpreadFighter cannot and will not be liable for any loss or damage arising from your failure to comply.

SpreadFighter considers private information on the site (source code of protected or invite-only scripts, etc.) to be confidential to you. SpreadFighter protects such private information from unauthorized use, access, or disclosure in the same manner that it protects personal data (please refer to our Privacy Policy for more information).

13. Payment and cancellation of service
By ordering any subscription on www.spreadfighter.com (including a free trial period) you confirm that you have read and accepted our Terms of Use and you authorize SpreadFighter to automatically charge your bank card or PayPal account according to the billing period manually selected by you.
Each user can try selected paid plans for 30 days free of charge. If the trial is not cancelled before its expiration date, it automatically converts to a monthly or annual paid plan depending on user’s choice. There are no refunds for monthly plans, even if the subscription is canceled on the same day as the autoconversion payment has gone through. Refunds are available only after an automatic deduction for annual payments (i.e. after trial and after renewal) within 14 calendar days after the payment was made. Please note that users who filed a chargeback/dispute request or a claim are not eligible for a refund. Essential, Plus and Premium subscriptions automatically include market data that is available without additional per-user fees only. You can see which markets are available for free and which need to be purchased separately on the SpreadFighter GoPro page. A cancelled trial and associated services will stop immediately after cancellation, except for any data packages that were purchased.
The service is billed in advance on a monthly, annual, or 2-year basis. There will be no refunds or credits for partial months of service, or refunds for months unused with an open user account. If auto renewal fails for an annual plan you will automatically be switched to a monthly plan.
All billing is recurring, which means you will continue to get billed until you cancel your subscription. You are solely responsible for properly canceling your SpreadFighter subscription. An email request or support ticket asking for your subscription to be cancelled is not considered cancellation. You may cancel your subscription at any time by visiting the billing section of your Profile Settings page.
If you cancel the service before the end of your current paid up period, your subscription will remain active until the next due date. After the due date, if no payment received, your subscription will be stopped.
We do not offer refunds for initial payments. If you order the service for the first time, please make sure that the order is correct before the payment is made.
We do not offer refunds for recurring monthly payments. If you have been billed for automatic monthly renewal of the Service, you can cancel the subscription to avoid billing for next months.
We do not offer refunds for upgrades to a more expensive plan or a longer billing cycle. Remaining days are converted into an equivalent value of days on the new subscription.
We offer refunds for recurring annual and 2-year payments on demand. If you have been billed for automatic annual and 2-year renewal of the service, you have 14 calendar days (after the payment was made) to contact our support team. If you don't do this, SpreadFighter assumes that renewal of the service is expected and the payment will not be refunded.
Refunds are available only after an automatic deduction for annual payments (i.e. after trial and after renewal) within 14 calendar days after the payment was made.
Our moderators are official SpreadFighter representatives, with the authority to warn or ban users (including those with a paid subscription) when they do not abide by the House Rules. We do not offer refunds in case you are banned from publishing content and interacting with others because your paid subscription and all of its data and/or features are still available during any such ban.

SpreadFighter, LLC may use local subsidiaries or other entities to collect payments in certain geographies. However, all payments will be processed and managed by SpreadFighter, LLC, and the service will be provided by SpreadFighter, LLC, regardless of which entity collects the payment.

14. Apple App Store subscriptions
Payments will be charged to the user's Apple ID Account at confirmation of purchase in compliance with Apple's privacy policy. We recommend that you familiarize yourself with the terms of payment and Apple in-app subscriptions. If a purchase is made from our iOS app, the refund is only possible in compliance with the App Store policy.
SpreadFighter offers a trial period. It is only possible to use the trial period once. Subscription payment begins after the end of your free trial period.
All subscription types are renewed automatically. You can cancel the renewal option in the App Store within at least 24 hours before the end of your free trial period or the current payment date. The cancellation comes into effect at the end of the current billing period. At the same time, you retain access to the subscription from the cancellation moment until the end of the current billing period.
Accounts may be charged for renewal up to 24 hours before the end of the current period.
Rates offered in mobile stores and on the web-based platform might differ. Mobile stores offer subscriptions based on two billing cycles: annual and monthly.
15. Android app subscriptions
Financial transactions for subscriptions made in our Android app processed by a third-party service (Google Play) in compliance with their terms of use, privacy policy and any applicable payment terms, in particular the response on Google Play refunds. SpreadFighter is not responsible for the actions or omissions of any third-party payment processor. We recommend that you familiarize yourself with the terms of payment and Google Play in-app subscriptions. If a purchase is made from our Android app, the refund is only possible in compliance with Google Play policy.
SpreadFighter offers a trial period. It is only possible to use the trial period once. Subscription payment begins after the end of your free trial period.
All subscription types are renewed automatically. You can cancel the renewal option in Google Play within at least 24 hours before the end of your free trial period or the current payment date. The cancellation comes into effect at the end of the current billing period. At the same time, you retain access to the subscription from the cancellation moment until the end of the current billing period.
The payment is made according to the payment method that is linked to the user's account in Google Play. The subscription is made according to Google Play Account choice, which does not necessarily conform with the Google Account used to log in to the application.
Rates offered in mobile stores and on the web-based platform might differ. Mobile stores offer subscriptions based on two billing cycles: annual and monthly.
16. Feedback to SpreadFighter
By submitting ideas, content, suggestions, documents, and/or proposals ("Contributions") to SpreadFighter through our contact or feedback webpages, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) SpreadFighter is not under any obligation of confidentiality, expressed or implied, with respect to the Contributions; (c) SpreadFighter shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) SpreadFighter may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of SpreadFighter, without any obligation of SpreadFighter to you; and (f) you are not entitled to any compensation or reimbursement of any kind from SpreadFighter under any circumstances.

17. Indemnity
You agree to indemnify and hold SpreadFighter and our subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit, modify or otherwise make available through the SpreadFighter services, your use of the SpreadFighter services, your connection to the SpreadFighter services, your violation of the Terms of Use, or your violation of any rights of another.

18. Termination
Upon your request, your account can be deleted from SpreadFighter. You may delete your account at any time by visiting your Profile Settings page. If you requested your account be deleted, we will delete the personal data associated with your account, however certain personal data will be retained if it has been integrated into data that is integral to our systems and site, including data in communications you have sent via our site. This data is necessarily retained for the integrity of the data on the site and our legitimate business purposes, including auditing, security and other legitimate interests (please refer to our Privacy Policy for more information). You agree that SpreadFighter may, without prior notice, immediately terminate, limit your access to or suspend your SpreadFighter account, any associated email address, and access to the SpreadFighter services. Cause for such termination, limitation of access or suspension shall include, but not be limited to, (a) breaches or violations of the Terms of Use or other incorporated agreements or guidelines, (b)requests by law enforcement or other government agencies, (c) discontinuance or material modification to the SpreadFighter services (or any part thereof), (d) unexpected technical or security issues or problems, (e) extended periods of inactivity, (f) and/or engagement by you in fraudulent or illegal activities. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in SpreadFighter's sole discretion and that SpreadFighter shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the SpreadFighter services.

19. Emails
By creating an account with SpreadFighter, you agree that SpreadFighter can use your email address to send you marketing materials, service-related notices, important information messages, special offers, etc. You can unsubscribe from this by clicking on the link provided in the emails.

20. House rules
By creating and using an account on SpreadFighter you confirm you have read and agree to follow our House Rules.

21. Third Party Software
Our software, website and/or services may include software components supplied by third parties which are utilized by permission of the respective licensors and/or copyright holders on the terms provided by such parties ("Third Party Software"). You represent and warrant that you have all intellectual property rights, including all necessary patent, trademark, trade secret, copyright or other proprietary rights, in and to your script. If you use third-party materials, you represent and warrant that you have the right to distribute third-party material in the script. You agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including patent, privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to submit the material.

You are solely responsible for any script that you create. SpreadFighter is not in any way responsible for the use or misuse of your script by any user. SpreadFighter is not in any way responsible for the use or misuse of any user’s script by you.

By using the publish script feature, you grant us a world-wide, irrevocable, perpetual, royalty-free license to:

publish this script as well as the username of the author;
disclose the source code of the script for open scripts;
perform, display, use and make available your open or protected script for any user or an invite-only script for any user that received an invite.
We may remove your script without notice if we reasonably believe that you are in violation of these Terms of Use.

You can publish the script under any license. If you do not include the license in the comment section of a script, you agree that your script is licensed under the Mozilla Public License 2.0.

24. SpreadFighter Coins Referral Program Rules
Who is eligible to be a referrer?
Any SpreadFighter account holder can become a referrer.

Who is eligible to become a referee?
Your friends or social media followers may be eligible to be referees. To receive coin rewards for referring someone who orders a paid plan on SpreadFighter, your referee must be a new SpreadFighter user and can’t have more than one account.

How can I use my referral link?
SpreadFighter wants you to share your referral link and earn SpreadFighter coins, but you agree that you will not:

Try to get referees by spamming, bulk emailing, or sending large numbers of unsolicited emails. The only people you should be emailing are people you know personally;
Use, display, or manipulate SpreadFighter intellectual property (such as SpreadFighter logos, trademarks, and copyright-protected works) in any way, except as to identify yourself as a SpreadFighter user or a SpreadFighter referrer;
Create or register any (i) businesses, (ii) URLs, (iii) domain names, (iv) software application names or titles, or (v) social media handles or profiles that include the word "SpreadFighter" or any of SpreadFighter's other trademarks or any words that are confusingly similar to SpreadFighter trademarks.
Purchase keywords (including, but not limited to Google AdWords) that contain any of SpreadFighter trademarks;
Use automated systems or bots through any channel to distribute, post, or otherwise share your referral link;
Use scripts or programmed or automatic dialers to send invites or otherwise share your referral link;
Make misleading claims about SpreadFighter, use offensive/abusive content, create fake websites/webpages/social media profiles/apps, misrepresent your connection to SpreadFighter, or otherwise make any false or misleading statements to get a referee to use your link; or
Use your referral link in any manner that violates the law or SpreadFighter House Rules.
How do I earn SpreadFighter Coins?
Referrers get rewarded with SpreadFighter coins for inviting new users that purchase subscriptions. As long as you and your referee follow these Rules, as well as SpreadFighter's posted policies, you should receive your SpreadFighter coins after your referee uses your link to sign up with SpreadFighter and makes their first payment within three months of creating their account. As a result, referrers receive SpreadFighter coins in the amount of $15 for their purchase of any subscription. To receive SpreadFighter coins for referring someone who orders a paid plan on SpreadFighter, your referee must be a new SpreadFighter user. Note that the bonus can be given only for purchases made on the website, not in the apps.

The requirements for receiving, and the amounts of SpreadFighter Coins are subject to change at SpreadFighter’s sole discretion. Referral rewards in the form of SpreadFighter coins are not transferable, have no cash value, and may expire. SpreadFighter may cancel a reward at any time at its sole discretion.

In case your referee files a chargeback or claims a refund for their paid subscription, the reward that you and your referee both received from SpreadFighter will be canceled.

How do I spend SpreadFighter Coins?

Termination and changes
SpreadFighter reserves the right to change, end, or pause, in whole or in part, any referral program, as well as any referrer’s or referee's ability to participate in any referral program or receive SpreadFighter Coins at any time for any reason, including suspected fraud (including by either the referrer and/or referee), abuse, or any violation of these Rules.
